Is Hong Kong Ready For The NEC?

This paper is the winner of the 2011 Society of Construction Law Hong Kong essay prize. A presentation based on the paper was given to members of The Society of Construction Law Hong Kong in Hong Kong on 15th March 2012

The Hong Kong (HK) Government is currently trialing the use of the NEC contract in HK3. There are several reasons for this including the expectation that it will improve project delivery, develop integration and partnering and allow a fairer and more appropriate allocation of risk4. The presumption is that this should reduce conflict and dispute resulting in further efficiencies.

This paper firstly reviews some key aspects of the ECC contract (Part I) and then examines the ECC project management process in the light of experience in the United Kingdom (‘UK’) and how this may be applicable to HK (Part II).

In the paper to the SCLHK, the author discusses:
