Headlines: Merits win cases; Experts – pick the right ones and do not over rely on them; Privilege and getting the embarrassing documents out – make life as difficult as possible for the opposite side - find the dirt; Your client’s own documents - you can make bricks out of straw; Check the contract, check and the contract and check it again - have the claims been properly notified, who had design responsibility etc.; Notifications are to be judged not just on their face but also by what the person receiving them knew. If employer cannot produce the person who received the notice, this will put them at a significant disadvantage; Delay: what matters most is providing a graphical representation of what in fact cause delay on the project with hindsight - does not matter whether you do so retrospectively or prospectively.
