Andrew Rigney KC - Insurance Coverage in Construction Projects

In this talk, Andrew Rigney KC will: provide an overview of the role of professional indemnity, public liability and construction all risks (CAR) policies; analyse CAR policies in detail, including the structure of CAR policies, the meaning of “defect” and “damage”, common exclusions (DE and LEG) and co-insurance; and discuss recent case law.

Andrew has extensive experience of, and expertise in, the major standard construction forms, including FIDIC, NEC, JCT and IChemE, and of leading large, multi‑disciplinary teams on disputes ranging into billions of US dollars relating to some of the largest construction and engineering disputes across the world, including the Middle East, Africa, Europe, Asia and, increasingly, in Hong Kong. 

In addition, he has extensive experience of, and expertise in, large-scale insurance disputes relating to CAR/EAR policies (including DE and LEG clauses), property risks, business interruption claims, and professional indemnity, public liability, employers liability, product liability and war and political risk polices.

Andrew has appeared in milestone cases such as the FCA Covid‑19 Business Interruption Test Case in the UK Supreme Court and Sky v Riverstone [EWCA] Civ 1567 in the Court of Appeal, and is instructed in some of the most substantial disputes relating to fire claims and defective cladding in high-rise buildings (as well as disputes as to insurance coverage for such claims), including the high-profile Grenfell Tower litigation arising out of the catastrophic fire at Grenfell Tower in London 2017.
